Who Pays

Post by apexblue »

Guest has accidently turned a tap on getting a highchair which someone had wedged against the washing machine causing ruined laminate to hall floor. First estimate £500. We hold deposit £100. Owner wants to claim. Views appreciated.

Insurance?
Some guests just need a sympathetic pat. On the head. With a hammer.

Will the deposit cover the insurance excess?

Insurance claim yes not sure on excess. Should guest loose their deposit?

My gut feeling is no - they needed the high chair which had been wedged behind something which, unless they did that themselves, is not their fault. It should have been more easily accessible. Also, why is there a tap that can be knocked on so easily, not leading to a sink or drain in this property? Why did it cause damage so quickly (I'm making assumptions here... obviously haven't seen the property but I would have thought the guests would notice gushing water pretty quickly)... was it poor quality laminate? Again, this isn't the guest's fault... the rental should be robust enough to withstand what appears to be a minor accident.

Can it be proven that it was this guest retrieving the highchair that caused the leak rather than whoever put the highchair there in the first place?
